This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name www.cabryder.com ('Website'), including the related mobile site and mobile application (hereinafter referred to as 'Platform').

1. Ownership & Registration

The Platform is owned and operated by Cabryder (GSTIN: 19CNMPM8987M1ZM) (hereinafter referred to as ‘Platform Owner’, 'we', 'us', 'our').

2. Agreement to Terms

Your use of the Platform and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction.

These Terms of Use relate to your use of our website, software platform, or services (collectively, 'Services'). These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

3. Terms of Service & User Obligations

• To access and use the Services, you agree to provide true, accurate and complete information during and after registration.
• Your use of our Services and the Platform is solely at your own risk and discretion. You are required to independently assess and ensure that the Services meet your operational requirements.
• The contents of the Platform and Services are proprietary to us. You acknowledge that unauthorized use may lead to legal action under applicable laws.
• You agree to pay the usage charges associated with availing the Services, including duty-slip generation and subscription charges where applicable.
• You agree not to use the Platform for any unlawful, illegal, or forbidden purpose under Indian or local laws.

4. Account Termination, Platform Migration & Data Export Policy

Cabryder provides multi-tenant cloud software solutions to car rental agencies, tour operators, and fleet businesses. If a registered user or business entity decides to discontinue services, terminate their subscription, or migrate their operational database to an alternative platform or software provider (‘Platform Migration’), the following data export terms shall strictly apply:

• Routine Operational Downloads: Throughout the active term of your subscription, your designated administrators retain regular access to generate, view, and download individual duty slips, trip sheets, GST tax invoices, and standard operational reports directly from the Cabryder web portal interface.
• Comprehensive Bulk Data Dumps & Migration Archive: If an account holder requests a complete raw database dump, comprehensive historical booking ledger, or bulk data export for the purpose of shifting to another system or archiving offline records, such bulk data exports are processed, compiled, and provided exclusively at the close of the financial year on March 31st (March End).
• Annual Audit & Technical Reconciliation Rationale: Multi-tenant cloud architectures require structured tenant isolation, cryptographic integrity validation, financial year-end GST audit reconciliation, and security sanitization to prevent data leakage and maintain statutory accounting compliance. Consequently, migration data export requests submitted at any time during an ongoing fiscal year will be scheduled and fulfilled during the subsequent annual March closing cycle.
• Prerequisites for Export Release: To receive the scheduled March year-end data dump, the requesting account must submit a formal written request via their registered email address to support@cabryder.com and ensure that all outstanding service fees, duty slip usage charges, and statutory dues are settled in full prior to release.

5. Governing Law & Jurisdiction

These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.
